AutoBidz.com Terms and Conditions

1. Acceptance of Terms
By accessing or using AutoBidz.com (“we,” “us,” or “our”), you (“User,” “Buyer,” or “Seller”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our website.
2. Eligibility
Our platform is intended for use by licensed and commercial vehicle buyers and sellers. By using AutoBidz.com, you represent and warrant that you have the authority to enter into these Terms and that all information you provide is accurate and complete.
3. Platform Role
AutoBidz.com provides an online marketplace to facilitate vehicle transactions between Buyers and Sellers. We do not take title to any vehicles listed on the platform and are not a party to the actual transaction between Buyers and Sellers.
4. Seller Obligations
Sellers agree to:
- Provide accurate and complete information about vehicles listed for sale.
- Ensure they have the legal right to sell each vehicle and that it is free from liens or encumbrances, except as disclosed.
- Comply with all applicable laws and regulations.
- Transfer the risk of loss to the Buyer once the vehicle is removed from the Seller’s premises.
- Respond promptly to accepted bids and coordinate timely pickup or delivery of the vehicle.
Note: AutoBidz.com does not charge any fees to Sellers for listing, selling, or canceling a transaction.
5. Buyer Obligations
Buyers agree to:
- Honor their bids, which remain valid for five (5) business days from the time the bid is placed.
- Complete payment within the timeframe specified upon acceptance of the bid or as otherwise agreed upon with the Seller.
- Accept risk of loss upon removal of the vehicle from the Seller’s premises.
- Comply with all applicable laws and regulations.
- Coordinate with the Seller in a timely manner for payment and vehicle pickup.
6. Dispute Resolution
In the event of a dispute between a Buyer and a Seller, both parties agree to first attempt to resolve the matter directly and in good faith. If the issue cannot be resolved, either party may contact AutoBidz.com for assistance. While we may offer facilitation support, AutoBidz.com does not guarantee resolution and assumes no liability for outcomes.
7. Limitation of Liability
AutoBidz.com is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our platform. Our total liability for any claim shall not exceed the amount paid by you to us (if any) in the 12 months prior to the claim.
8. Changes to Terms
We may update these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of the platform constitutes your acceptance of the revised Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.
